Rule 133
Family Pension and Gratuity

(1) If a police officer dies while in service or within seven years of receiving pension, his family or his minor brother or unmarried sister will receive gratuity or pension as written in rule 130 or 131. But in the case of pension, such pension will not be received for more than seven years. Family members or minor brothers or unmarried sisters of a police officer who died before seven years of starting to receive pension will not receive pension after seven years.
(2) Notwithstanding anything mentioned in sub-rule (1), if the person receiving pension is a minor, he shall receive such pension until he attains the age of eighteen years.
(3) If the widowed spouse or widowed wife of a police officer dies within seven years of his or her spouse being in service or within seven years of receiving the pension, the family pension shall be paid as per sub-rule (1), the period of receiving such pension shall be from the date of payment and if such pension shall not be received or his or her spouse or If the wife dies after seven years have passed since she started getting pension, she will get half of the amount of pension she would get from the date of her death.
(4) When the salary of the existing police personnel is increased, two-thirds of the increase in the initial salary will be added to the family pension amount received by the person receiving family pension according to sub-rules (1), (2) and (3).
(5) If a police officer dies before receiving any amount due under this regulation, the person who is determined to receive his pension or gratuity from among the members of his family will be entitled to receive that amount.
(6) When giving pension or gratuity, if the deceased police officer does not wish to be a member of his family or a minor brother or unmarried sister-in-law, the amount shall be given to a person deemed appropriate by the Government of Nepal from among his family members.
